1. Acceptance of Terms

By accessing and using the ACREE Design website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

• Clients who engage our digital marketing services

• Any third parties accessing our content or services

2. Services Description

ACREE Design provides comprehensive digital marketing services including but not limited to:

• Search Engine Optimization (SEO): On-page and off-page optimization, keyword research, technical SEO, and local SEO services
• Paid Advertising: Google Ads, Facebook Ads, and other platform advertising management
• Social Media Marketing: Content creation, community management, and social media strategy
• Email Marketing: Campaign creation, automation, and list management
• Content Marketing: Blog writing, video content, and content strategy development
• Analytics and Reporting: Performance tracking, custom dashboards, and ROI analysis

Service specifications, deliverables, and timelines will be detailed in individual service agreements or statements of work.

3. User Obligations

As a user of our services, you agree to:

• Provide accurate, current, and complete information when requested
• Maintain the security of your account credentials
• Use our services only for lawful purposes and in accordance with these Terms
• Not interfere with or disrupt the integrity or performance of our services
• Not attempt to gain unauthorized access to our systems or networks
• Respect intellectual property rights of ACREE Design and third parties
• Comply with all applicable laws and regulations

You are responsible for all activities that occur under your account and for maintaining the confidentiality of your account information.

4. Payment Terms

Payment terms for our services are as follows:

• Payment Schedule: Payments are due according to the schedule specified in your service agreement
• Late Payments: Late payments may result in service suspension and additional fees
• Refunds: Refund policies are specified in individual service agreements
• Price Changes: We reserve the right to modify our pricing with 30 days' notice
• Taxes: All prices are exclusive of applicable taxes unless otherwise stated

Failure to make timely payments may result in suspension or termination of services. You remain responsible for all charges incurred prior to termination.

5. Intellectual Property Rights

The content, features, and functionality of our website and services are owned by AC Design Concepts and are protected by copyright, trademark, and other intellectual property laws.

Our Rights

• All website content, including text, graphics, logos, and software
• Proprietary methodologies and processes
• Reports and analyses created using our proprietary methods
• Training materials and documentation

Client Rights

• Content provided by clients remains their property
• Clients retain rights to their business information and data
• Work product specifically created for clients as outlined in service agreements

6. Limitation of Liability

To the fullest extent permitted by applicable law, ACREE Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Business interruption
• Personal injury or property damage

Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

Performance Disclaimer: While we strive to deliver excellent results, we cannot guarantee specific outcomes such as search engine rankings, traffic increases, or conversion improvements, as these depend on various factors beyond our control.

7. Termination

Either party may terminate services under the following conditions:

Termination by Client

• 30 days written notice for ongoing services
• Immediate termination for cause with written notice
• Payment of all outstanding fees through the termination date

Termination by ACREE Design

• Immediate termination for breach of these Terms
• 30 days notice for convenience
• Non-payment of fees after 15 days written notice

Upon termination, we will provide a final report of work completed and transfer any client-owned assets as specified in the service agreement.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Dispute Resolution Process

1. Direct Negotiation: Parties will first attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes will be submitted to mediation
3. Arbitration: Unresolved disputes will be settled through binding arbitration
4. Jurisdiction: Any legal proceedings will be conducted in Broward County, Florida
